Legal Issues

Civic Government (Scotland) Act 1982

Section 52 of the Civic Government Act provides that any person who distributes or shows an indecent photograph of a child or publishes or causes to be published any advertisement likely to be understood as conveying that the advertiser distributes or shows such an indecent photograph is guilt of an of an offence.

Telecommunications Act 1984

The transmission of an obscene or indecent image from one computer to another via "a public communications system" is an offence under section 43 of the act. Traditional mail is covered by the Poat Office act 1953.

Computer Misuse Act 1990

Protection of Personal Information (PPI) and Data Protection Acts

All personal information is covered by the above noted acts and system administrators are responsible for ensuring that access is restricted and secured.

For this reason, registered members will be required to agree to a number of policies (to be published) prior to being given access to the members area. These policies will include :

• Club Conditions of use policy
• Terms of the PPI and Data Protection acts
• Terms of the Computer Misuse act
